1. Scope

This Privacy Policy explains how Nudgen LLC collects, uses, shares, and protects information when you use the Nudgen website, application, and related services (the "Service").

Nudgen is a platform for creating, sending, and analyzing retention and lifecycle email campaigns. This policy applies to information collected from account holders, team members, visitors, and message recipients whose data is processed through the Service.

2. Information We Collect

We may collect the following categories of information:

  • Account and profile information, such as name, email address, avatar, authentication identifiers, and active workspace preferences.
  • Team and workspace information, such as team names, slugs, membership roles, invitations, signatures, and brand settings.
  • Customer contact data uploaded by our customers, including contact email addresses, names, tags, encrypted metadata, and suppression status.
  • Campaign and content data, such as campaign names, prompts, generated copy, HTML email content, links, schedules, drip configuration, and stop rules.
  • Billing and subscription information, such as plan tier, subscription status, trial dates, usage counters, customer IDs, subscription IDs, order references, and coupon-related data.
  • Usage, analytics, and device information, such as browser and device details, referral data, product interactions, and information collected through analytics tools.
  • Email engagement and delivery data, such as sent, delivered, opened, clicked, bounced, unsubscribed, failed, and spam complaint events.
  • Support and operational information, such as logs, rate-limit events, security events, and administrative troubleshooting data.

3. Sources Of Information

We collect information directly from you, automatically, and from service providers.

  • Directly from you when you create an account, connect a workspace, upload contacts, or configure campaigns.
  • From your organization or teammates when they invite you to a workspace or administer a shared account.
  • Automatically from your use of the Service, including application events, analytics, and email interaction telemetry.
  • From third-party providers that support the Service, such as authentication, billing, hosting, delivery, and analytics partners.

4. How We Use Information

We use information to operate, secure, and improve the Service, including to:

  • Authenticate users and manage accounts, teams, and permissions.
  • Store brand settings, generate campaign drafts, and provide editing, preview, testing, and sending workflows.
  • Import, organize, and deduplicate contact records and maintain suppression status.
  • Send campaigns, test messages, team invitations, transactional notices, and billing-related communications.
  • Measure engagement such as opens, clicks, bounces, complaints, and unsubscribes.
  • Enforce usage limits, rate limits, anti-abuse safeguards, and deliverability protections.
  • Process subscriptions, billing changes, and customer portal requests.
  • Analyze performance, diagnose issues, and improve features, reliability, and security.
  • Comply with legal obligations and enforce our agreements and policies.

5. Customer Data And Recipient Information

Customers may upload recipient and prospect data into Nudgen for use in retention and lifecycle campaigns. In that context, our customers determine what recipient information they upload and why they use it.

If you are a recipient of an email sent through Nudgen, the sender is generally the party primarily responsible for that outreach and for its legal basis. Nudgen processes that information on behalf of the customer in order to provide the Service, including email sending, tracking, suppression handling, and analytics.

6. Tracking, Analytics, And Similar Technologies

Nudgen uses tracking technologies to measure service usage and email campaign performance. For example, messages sent through the Service may include tracking pixels, signed click-tracking links, and unsubscribe links.

When those tools are triggered, we may process information such as browser and device details, approximate location derived from IP address, email client information, referral data, and event timestamps. We also use application analytics technologies, which may rely on cookies, browser storage, or similar identifiers.

7. AI Features

Nudgen offers AI-assisted email generation features. When you use those features, we may process prompts, campaign goals, brand voice instructions, examples, and related content in order to generate draft email content for you.

You are responsible for reviewing AI-generated output before use. Generated content may be inaccurate, incomplete, or unsuitable for your intended purpose.

8. How We Share Information

We may share information in the following circumstances:

  • With service providers that help us run the Service, such as authentication, analytics, billing, hosting, AI, geolocation, and email delivery providers.
  • With other members of your workspace, based on your team role and the permissions available within the product.
  • With our administrators and personnel who need access for operations, support, fraud prevention, or security.
  • When required by law, legal process, or a valid governmental request.
  • In connection with a merger, financing, acquisition, restructuring, or sale of assets.
  • To protect rights, safety, property, the Service, our users, or the public.

9. Service Providers And Integrations

The Service may rely on third-party providers such as Google/Firebase for authentication and analytics, Polar for subscription management, Postmark for email delivery and suppression handling, OpenAI for AI generation, and MaxMind for approximate geolocation. Our providers may change over time as the Service evolves.

10. Data Retention

We retain information for as long as reasonably necessary to provide the Service, maintain security and operational records, comply with legal obligations, resolve disputes, and enforce agreements.

Retention periods may differ depending on the type of data. For example, we may retain account records, billing records, suppression records, security logs, and campaign history for different periods based on operational or legal needs.

11. Security

We use reasonable technical and organizational measures designed to protect information. For example, certain contact fields are encrypted at rest, contact emails may be hashed for deduplication, access is role-based within workspaces, and signed links and validation checks are used in parts of the tracking flow.

No method of transmission or storage is completely secure, and we do not guarantee absolute security.

12. International Transfers

We and our service providers may process information in countries other than the country where you live. By using the Service, you understand that information may be transferred to and processed in the United States and other jurisdictions that may have different data protection rules.

13. Your Choices And Rights

Depending on your location and applicable law, you may have rights to request access to, correction of, deletion of, or restriction of certain personal information.

You may also be able to unsubscribe from marketing emails sent through Nudgen using the unsubscribe link included in those messages. If you are a recipient of a customer campaign, you may also contact the sender directly regarding their use of your data.

14. Children's Privacy

The Service is not directed to children under 18, and we do not knowingly collect personal information from children under 18 for our own independent business purposes.

15. Changes To This Policy

We may update this Privacy Policy from time to time. If we make material changes, we may provide notice through the Service, by email, or by updating the effective date above.
